Aivilla Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Aivilla (“Aivilla,” “we,” “us,” or “our”), including our website, application, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who These Terms Apply To

Aivilla is used by three types of participants:

  • Owners — short-term rental property owners or managers who create an account and are billed for the Service
  • Cleaners — individuals added by an Owner who access job details via a secure, tokenized link, without creating an account
  • Guests — individuals staying at a property who may access a guide via a secure, tokenized link

Sections of these Terms apply differently depending on your role, as noted below. Owners are responsible for the accuracy of information they provide about their Cleaners and Guests.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to create an Owner account. By creating an account, you represent that you have the authority to manage the properties you add to Aivilla.

3. The Service

Aivilla is operations software that sits on top of your existing property management system and booking calendars. It does not replace your PMS, process guest payments, or act as a booking platform. Aivilla:

  • Derives turnovers from your synced booking calendars
  • Coordinates cleaner job assignments and verification
  • Tracks maintenance issues reported through the platform
  • Sends transactional notifications by SMS, email, or in-app alerts

Calendar sync accuracy. Aivilla relies on iCal feeds and other data you or your PMS provide. We are not responsible for errors, omissions, or delays originating from third-party calendar sources.

4. Accounts and Access

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • Cleaner and Guest links are single-purpose and may expire or be revoked by the Owner. You agree not to share these links with anyone outside their intended purpose.
  • You agree to notify us promptly of any unauthorized use of your account.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to access another Owner’s properties, data, or accounts without authorization
  • Interfere with or disrupt the Service, including attempting to bypass tokenized link security
  • Use the Service to send unsolicited communications unrelated to property operations
  • Reverse-engineer or attempt to extract the underlying source code of the Service, except as permitted by law

6. SMS and Communications

By providing a phone number and opting in, you agree to receive transactional text messages related to turnovers, cleaning jobs, and maintenance updates. Aivilla does not send marketing texts. Message and data rates may apply. You may opt out at any time by replying STOP. See our Privacy Policy for details on how we handle phone numbers and messaging data.

7. Fees and Payment

Available upon request.

8. Data and Content

  • Your content. You retain ownership of the property, booking, and operational data you input into Aivilla. You grant us a license to use it solely to provide and improve the Service.
  • Photos. Photos uploaded by Cleaners for job verification are stored as part of your property’s event record and are visible to the Owner.
  • Accuracy. You are responsible for the accuracy of information you provide, including property details and Cleaner contact information.

9. Third-Party Services

Aivilla relies on third-party providers to operate, including hosting (Vercel), database and authentication (Supabase), and email delivery (Resend). We are not responsible for outages or failures originating from these providers, though we will work to minimize disruption to your Service.

10. Termination

  • You may cancel your account at any time; see your account settings or contact us.
  • We may suspend or terminate access if you violate these Terms, misuse the Service, or if required by law.
  • Upon termination, Cleaner and Guest links associated with your account will be deactivated. We will retain data as described in our Privacy Policy.

11. Disclaimers

The Service is provided “as is” and “as available.” Aivilla does not guarantee that the Service will be uninterrupted, error-free, or that calendar syncing, notifications, or job tracking will be free of delay or inaccuracy. Aivilla is operational support software — it does not guarantee the outcome of any cleaning job, maintenance issue, or guest interaction, and Owners remain responsible for the operation of their properties.

12. Limitation of Liability

To the maximum extent permitted by law, Aivilla and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of revenue, profits, or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold Aivilla harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a Cleaner, Guest, or third party.

14. Changes to the Service or Terms

We may update these Terms from time to time. We will update the “Last updated” date, and for material changes, provide reasonable notice. Continued use of the Service after changes take effect constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles.
